Does a resident director have to be present in Seychelles during the application process?
At the application stage, the person who will act as the resident director must be identified, even if they are not physically present in Seychelles at that time. If a license is issued in such a situation, it will be accompanied by a condition that the identified person must become resident in Seychelles within a reasonable period of time to comply with the presence requirement.
What are the record keeping obligations of a company with a VASP license?
A licensed VASP must keep records of both its client and proprietary transactions at its principal place of business for at least 7 years from the date of the transaction.
Can one individual perform two roles requiring security clearance?
The same individual may perform dual roles, provided that they have undergone due diligence and can effectively demonstrate that they are qualified to perform the relevant duties required for each role, and that they have communicated the steps taken to mitigate any potential conflict of interest.
